4. Definition of the Parties and Geographical Area

In these Terms and Conditions, “Apoticari” refers to the company Apoticari SAS, “you” refers to the buyer, and “Products” refers to the items offered on the website www.apoticari.com . Online sales are reserved for residents of the European Union and for deliveries within this area.

5. Products

The products available for sale are described on the website. Photos and descriptions are provided to represent the product as accurately as possible but may contain minor variations. Products are available while supplies last. Apoticari strives to ensure product availability but reserves the right to limit quantities per order.

6. Order

To place an order, the customer must create an account by providing complete and accurate information. An order becomes effective upon receipt of payment. Apoticari reserves the right to refuse an order for justified reasons, including in the event of a prior payment dispute or fraudulent use of the website. The customer receives a confirmation email summarizing the products ordered, prices, and delivery address.

7. Price and Payment

8. Delivery

Apoticari offers delivery options tailored to customer needs. Delivery times and costs are indicated before order confirmation and vary depending on the destination. In the event of a delivery delay, Apoticari will endeavor to inform the customer as soon as possible. Delivery costs are fixed, and the customer is responsible for providing accurate address information. Any returned undelivered package will result in reshipment at the customer's expense.

9. Right of Withdrawal and Returns

In accordance with Article L.221-18 of the French Consumer Code, the customer has 14 days from the date of receipt of the products to exercise their right of withdrawal. Returned products must be in their original condition. Return shipping costs are the responsibility of the customer. The refund will be issued within 14 days of Apoticari's receipt of the returned products.

10. Legal Guarantees

Apoticari products are covered by the legal guarantees of conformity (articles L.217-4 et seq. of the French Consumer Code) and against hidden defects (articles 1641 et seq. of the French Civil Code). In the event of non-conformity or a hidden defect, the customer may request repair, replacement, or a refund for the products concerned. These guarantees do not cover defects resulting from misuse of the products by the customer.

11. Responsibility

Apoticari is committed to providing products that comply with applicable laws, but cannot be held liable for indirect damages, lost profits, or data loss. In the event of damage, Apoticari's liability is limited to the order amount. Apoticari is not responsible for technical problems beyond its control, including service interruptions due to internet disruptions.

Customer personal information is processed in accordance with our Privacy Policy. Apoticari is committed to never selling or disclosing personal data to third parties without the customer's authorization, except in the case of a legal request.

In accordance with Article L.223-2 of the Consumer Code, the consumer is informed that he/she can register free of charge on the telephone marketing opt-out list, accessible on the website www.bloctel.gouv.fr .

13. Intellectual Property
